Medical malpractice means that a health care professional, such as a doctor, nurse, dentist, medical technician, hospital worker or hospital, is negligent and causes injury or death. Medical malpractice lawsuits are complex. Not all bad medical outcomes are the result of medical malpractice. Not all medical mistakes cause injury. To prove medical malpractice in Maryland, you must demonstrate three things:
- that the healthcare provider did not meet the standard of care;
- that this failure to meet the standard of care was the cause of an injury; and
- the nature and extent of the injury
An expert in medical care must determine whether the healthcare provider met the applicable standard of care and what injuries occurred as a result.
